<p> 前不久，武汉有个另类“城管”蹿红网络。这名55岁的“城管”名叫杨维勋，曾当了28年的兵，2000年转业前是一名正团级干部。当城管后坚持秉公执法，对小商小贩笑脸执法，不没收小贩的摊位，而是劝他们并帮他们搬东西。杨维勋希望自己退休后能做义务城管工作，一面铲小广告，一面捡垃圾，还能给行人指指路。为大家服务，是他最大的心愿。</p>
<p> 近年来，关于武汉城管的新闻还真不少，人民网就曾报道，2012年年初，武汉新招了9名城管员，他们平均年龄24岁，其中4人是硕士研究生，1人是双学士，4人是本科生；1人通过英语专业八级，4人过了英语6级。武汉市的城管负责人介绍说，这批“80后”新人是因为他们学历高、点子多，希望他们多想新办法，破解城管执法中的老难题。为城管注入新的血液，对老城管形成刺激和压力，逐步改善城管的形象。报道还说，就职半年多来，这些“新生代”城管们的微笑执法、情感执法等赢得了执法对象的尊重和市民的赞许。</p>
<p> 关于城管，众多的媒体报道以及身边的事实经验，已经给了公众诸多刻板印象:比如追打小贩，比如经常使用暴力方法管理。所幸的是，城管自身也在思量自身角色的定位，也试图通过人性化执法，改变这些刻板现象。此次湖北武汉的杨维勋和武汉城管招收9名高学历城管就是一个明显的例子。但是，城管和流动摊贩的诸多冲突，并非是因性格相冲、一言不合造成的。深层次的冲突，是城管自身职能的尴尬。小摊贩带来的问题无非两个，要么是摆摊后导致周边环境变脏，且所销售的商品质量不能保证；要么是占道经营，挡住了交通。</p>
<p> 而现实状况是，面对小贩，我们城管通常是“管”字当头，既然是管理，就和服务的主次关系有了不同:前者以政府的意志为主导，后者以小贩的意志为取向。这种管理型的职能定位，最终导致了城市管理员和小贩谋生存的“斗法”。杨维勋的出现是个好现象，但不能完全消弭城管在市民当中的不良印象，最主要的是他的微笑执法，终究是管理而非服务，其职能和小贩的生存权还是有冲突之处。从小贩的角度出发，你即使带着笑容，有时还是挡了他的生路，遇到紧急情况，冲突可能还是难以避免。</p>
<p> 事实上，“城管”的形象改变，本来就不是靠微笑“笑出来”的，也不是单靠一个优秀的杨维勋或高学历的80后们能扭转过来的。“城管”的角色只有向服务型转变，不仅是微笑执法，还要微笑服务，在某些抵御适度开放摊贩经营，平衡市民和流动商贩的利益需求，方可让“城管”和小贩相敬如宾。</p>
